{"id":11009,"date":"2009-11-23T11:37:22","date_gmt":"2009-11-23T09:37:22","guid":{"rendered":"http:\/\/staging.sillon38.com\/?p=11009"},"modified":"2009-11-23T11:37:22","modified_gmt":"2009-11-23T09:37:22","slug":"peut-on-redimensionner-un-chemin-rural","status":"publish","type":"post","link":"https:\/\/www.sillon38.com\/blog\/2009\/11\/23\/peut-on-redimensionner-un-chemin-rural\/","title":{"rendered":"Peut-on redimensionner un chemin rural ?"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-11010\" title=\"orateur\" src=\"http:\/\/staging.sillon38.com\/wp-content\/uploads\/2009\/11\/orateur4.jpg\" alt=\"orateur\" width=\"115\" height=\"182\" \/>Mme Jacqueline Panis (Meurthe-et-Moselle- UMP-R) dans sa question \u00e9crite publi\u00e9e dans le JO S\u00e9nat du 24\/09\/2009 attire l&rsquo;attention de M. le ministre de l&rsquo;alimentation, de l&rsquo;agriculture et de la p\u00eache sur les difficult\u00e9s de circulation que rencontrent les exploitants agricoles sur les chemins d&rsquo;exploitation, ruraux et communaux.<\/p>\n<p>En effet, les normes de 4 m\u00e8tres de chauss\u00e9e et 7 m\u00e8tres de plateforme \u00e9tablies par l&rsquo;article D. 161 \u2013 8 du code rural, parfaitement justifi\u00e9es lors de la r\u00e9daction du code, s&rsquo;av\u00e8rent parfaitement inadapt\u00e9es au gabarit des engins agricoles actuels.<\/p>\n<p>Elle lui demande donc s&rsquo;il envisage un redimensionnement des chemins ruraux afin de les adapter aux contraintes techniques nouvelles.<\/p>\n<p><strong>R\u00e9ponse du minist\u00e8re<\/strong><strong> de l&rsquo;alimentation, de l&rsquo;agriculture et de la p\u00eache publi\u00e9e dans le JO S\u00e9nat du 19\/11\/2009 <\/strong><\/p>\n<p>Aux termes des dispositions de l&rsquo;article L. 161-1 du code rural, les chemins ruraux sont ceux qui, appartenant aux communes et affect\u00e9s \u00e0 l&rsquo;usage du public, n&rsquo;ont pas \u00e9t\u00e9 class\u00e9s en voies communales. Les chemins ruraux sont fr\u00e9quemment soumis \u00e0 des trafics importants et peuvent se r\u00e9v\u00e9ler inadapt\u00e9s, surtout avec l&rsquo;augmentation du poids et du gabarit des engins et des remorques agricoles.<\/p>\n<p>L&rsquo;article L. 161-5 du code rural pr\u00e9cise que l&rsquo;autorit\u00e9 municipale est charg\u00e9e de la police et de la conservation de ces chemins. Le maire peut donc, en vertu de ses pouvoirs de police, en interdire l&rsquo;usage sur tout ou partie aux cat\u00e9gories de v\u00e9hicules et de mat\u00e9riels dont les caract\u00e9ristiques sont incompatibles avec la constitution de ces chemins, et notamment avec la r\u00e9sistance et la largeur de la chauss\u00e9e ou des ouvrages d&rsquo;art.<\/p>\n<p>Ce m\u00eame code, dans son article D. 161-8, d\u00e9finit les caract\u00e9ristiques techniques g\u00e9n\u00e9rales que doivent pr\u00e9senter les chemins ruraux afin d&rsquo;assurer la s\u00e9curit\u00e9 et la commodit\u00e9 de la circulation.<\/p>\n<p>Le principe est de respecter les conditions impos\u00e9es par la g\u00e9ographie des lieux et les structures agraires et de satisfaire la nature et l&rsquo;importance des divers courants de desserte des terres et b\u00e2timents d&rsquo;exploitation, tels qu&rsquo;ils peuvent \u00eatre d\u00e9termin\u00e9s dans le cadre d&rsquo;une pr\u00e9vision d&rsquo;ensemble des besoins de la commune, compte tenu des cultures pratiqu\u00e9es et des mat\u00e9riels utilis\u00e9s. La chauss\u00e9e et les ouvrages d&rsquo;art doivent pouvoir supporter, avec un entretien normal, les efforts entrain\u00e9s par le passage des v\u00e9hicules et mat\u00e9riels couramment utilis\u00e9s dans la commune.<\/p>\n<p>Certaines caract\u00e9ristiques, parmi lesquelles la largeur et le trac\u00e9 des chemins, font l&rsquo;objet de pr\u00e9cisions dans le texte de l&rsquo;article pr\u00e9cit\u00e9. Ainsi, en r\u00e8gle g\u00e9n\u00e9rale et sauf circonstances particuli\u00e8res appr\u00e9ci\u00e9es par le conseil municipal, aucun chemin rural ne doit avoir une largeur de plateforme sup\u00e9rieure \u00e0 7\u00a0m\u00e8tres et une largeur de chauss\u00e9e sup\u00e9rieure \u00e0 4\u00a0m\u00e8tres.<\/p>\n<p>Toutefois, des surlargeurs doivent \u00eatre am\u00e9nag\u00e9es \u00e0 intervalles plus ou moins rapproch\u00e9s pour permettre le croisement des v\u00e9hicules et mat\u00e9riels lorsque, sur des sections donn\u00e9es, la nature du trafic le justifie.<\/p>\n<p>De plus, des dimensions sup\u00e9rieures \u00e0 celles r\u00e9glementairement fix\u00e9es peuvent \u00eatre adopt\u00e9es, lorsque des circonstances particuli\u00e8res les rendent n\u00e9cessaires : ces circonstances doivent \u00eatre appr\u00e9ci\u00e9es par le conseil municipal dans une d\u00e9lib\u00e9ration motiv\u00e9e.
